No-Fault Auto
August 19, 2004 by Bob Christensen
Today we drafted a No-Fault Itemization of Claim for a client and sent several prognosis requests out of the office with drafting help from Cindy. Now the agony is is to wait until the doctors can get around to looking at the project.
Doctors make more money treating patients, generally. However, some treating doctors have decided to take it to their own patient’s attorney, and will charge up to $1,000.00 per hour or more to meet with an attorney, give a deposition or review medical records.
The insurance industry has poisoned the well, and by doing so, have corrupted the national and state legislatures relating to the doctor/attorney relationship. A few good doctors out there still understand that patient care includes advocacy for their legal cause, but they are getting harder and harder to find.
Shame on those selfish bastards that are too godly to help a patient with their legal case. The adverse exam doctors hired by the insurance companies are sometimes paid $2,000.00- $3,000.00 for their opinions that the Plaintiff was not hurt, or if the Plaintiff was hurt it was “not that bad”, or the medical condition really was caused by a pre-existing condition.
Also worked on an insurance question relating to a subcontractor and required coverage, trademark, domain name and copyright issues, planning an ADR seminar for MTLA, answering discovery, working on finding out if two trusts need to be set up by a deadline, negotiating a cellular antenna lease amendment, advising a client relating to employment termination issues and worked on a disability claim.
Got several cases settled which were scheduled for trial in May and July in the last ten days. More cases scheduled for trial later in the year.
The Bait and Switch
August 12, 2004 by Bob Christensen
My client was fired when he refused to participate in an insurance bait and switch scam by his employer. Employees who put themselves at risk by becoming whistleblowers have a difficult, if noble, task ahead of them.
He was fired by the company after he contacted the Attorney General and raised his concerns. This man is a hero and he lost his job because of it. He exemplifies the kind of client we love to represent. He knew he had to do the right thing, did it, suffered the consequences and hired me.
Companies who are faced with the exposure of their illegal or unethical practices will do anything to get rid of the employee, including isolating them from their colleagues, setting them up for failure by overloading them with unmanageable projects, or even preparing to lay them off by manufacturing a poor job record out of thin air.
My client got a $37,000.00 offer before trial, and we obtained a verdict of $1,600,000.00. I hope that companies that practice illegal and immoral tactics such as these will eventually get the message.
From Small to Large

Some lawyers want and accept only the plums. These are companies with a strong balance sheet and want legal counsel around to bless the ego of management. We do not represent these companies.
Many of our strongest clients have come to us when they have lost their general counsel due to job change, death or disability, lack of interest by the attorney or lack of service.
Our corporate clients have come to us for simple advice and a mindful ear. We listen, we care and we become part of your management team. Whether it is a corporate governance issue or an employment related issue we can assist you with the most difficult issues which face your business.
