Supreme Court: Consumers Can Sue Drug makers

In a landmark decision, the U.S. Supreme Court has rejected the Bush Administration and Big Pharma’s claim that FDA approval of a warning label on a drug preempts any claim of inadequete warnings concerning the drug. This is an important decision, as it gives consumers recourse for drugs with labels that fail to fully disclose the potential dangers. hThe Supreme Court rejected the notion that government approval of a warning label is the end  of the responsibility  of drug companies with knowledge of undisclosed adverse effects.
